Mandatory Mediation In Family Disputes - Legal And Psychological Aspects

Abstract

The present report focuses on the legal and psychological aspects related to the amendments and additions to the Civil Procedure Code in the Republic of Bulgaria and the Law on Mediation, sent by the Supreme Judicial Council to the Ministry of Justice, related to the implementation of the mandatory mediation meeting within the framework of court proceedings. And although the title of the current development indicates mandatory mediation in court disputes for the purpose of popular understanding of the public related to the specifics of the introduced amendments, the correct definition is a mandatory mediation meeting. At the same time, this meeting does not oblige the parties to reach an agreement at any cost and does not prevent reaching a court, if necessary.
