Abstract

On sait que, depuis le traité de Rome, le droit européen est censé être neutre vis-à-vis de la propriété du capital, ce qui a pendant longtemps été interprété comme une acceptation de l’économie mixte et des entreprises publiques. Pourtant, progressivement et notamment sous la pression de la jurisprudence de la Cour de Justice de l’Union Européenne (CJUE), la perspective a changé. Un récent arrêt (3 avril 2014), vient confirmer cette évolution. De telle sorte qu’il est permis de se demander si l’entreprise de service public « à la française » est encore acceptable dans le cadre de l’UE.
