Abstract

En el mundo contemporáneo se ha tratado de reducir el hecho jurídico a un simple reflejo de la realidad económica, despejándola de todo contenido especifico. En ese afán han contribuido tanto la teoría de la utilidad individual como elemento motriz de la actividad económica, como un excesivo normativismo del Derecho que lo ha reducido a pura forma, carente de contenido (parte 2). Estas dos tendencias pueden corregirse a través de la utilidad social donde el Derecho, sirviendo de cauce a la Economía, se ponga junto con ésta al servicio de la comunidad, y no de unos pocos, los más fuertes (parte 3).
