Ekologik Nizolarni Hal Etishda Sud Amaliyotining O‘Rni: Xalqaro Tajriba Va Milliy Yondashuv

Abstract

Ushbu maqolada global ekologik inqirozlar sharoitida O‘zbekiston Respublikasi yangi tahrirdagiKonstitutsiyasining 49-moddasida mustahkamlangan fuqarolarning ekologik huquqlarini sud orqali himoya qilishmasalalari tahlil qilinadi. Maqolada ekologik nizolarni hal etishda milliy sud amaliyotining bugungi holati baholanib,Hindistonning Milliy Ekologik Sud hay’ati (NGT), Braziliya va Boliviyaning ilg‘or institutsional modellarini O‘zbekistonsud-huquq tizimiga implementatsiya qilish imkoniyatlari tadqiq etilgan. Hindiston tajribasi asosida milliy sudlardatexnik ekspertlar kengashlarini shakllantirish, Braziliya modeli tizimida jamoatchilik da’volari vakolatlarini kengaytirishhamda Boliviyaning tabiat obyektlari mustaqilligini tan olish yondashuvi prizmasida Orol bo‘yi kabi ekologik ofathududlariga mustaqil huquqiy subyektlik maqomini berish masalalari ilgari suriladi. Tadqiqot yakunida, O‘zbekistonmahalliy va ma’muriy sudlari tizimida ixtisoslashgan ekologik sud hay’atlarini tashkil etish bo‘yicha taklif va tavsiyalarberilgan.
