Abstract

Maqolada O‘zbekiston Respublikasida sud boshqaruvchilari faoliyatini iqtisodiy rag‘batlantirishtizimi va ularning javobgarligi instituti yagona rag‘batlar arxitekturasining o‘zaro bog‘liq ikki elementi sifatidatadqiq etilgan. Tahlil amaldagi normativ baza — “To‘lovga qobiliyatsizlik to‘g‘risida”gi Qonunning 25, 26, 59va 69–77-moddalari[1], Oliy sud Plenumining 2025-yil 23-iyundagi qarori[2], Vazirlar Mahkamasining 765-sonqarori[3] — hamda 2026-yil 6-maydagi PF-78-son Farmon[4] va PQ-172-son Qaror[5] bilan boshlangan tubislohotlar materiallariga asoslanadi. Prinsipal–agent modeli yordamida haq to‘lashning natijaga bog‘lanmagantuzilmasi sanatsiya samaradorligi pastligining (besh yilda 68 ta sanatsiya, 7 tasi muvaffaqiyatli) institutsionalomillaridan biri ekani asoslangan. Islohotlarning iqtisodiy yangiliklari — haqning bazaviy va KPIga bog‘liqqismlarga ajratilishi, boshqaruvchilarni inson omilisiz tasodifiy elektron tanlash, Sud boshqaruvchilaripalatasi negizidagi o‘zini o‘zi boshqarish, sudgacha sanatsiyani foizlar bo‘yicha moratoriy, soliq kechiktirishva davlat kafilligi vositalari bilan qo‘llab-quvvatlash — baholangan hamda ularni amalga oshirishdagi xavflarva qo‘shimcha takliflar ko‘rsatilgan. Subsidiar javobgarlik Plenum tushuntirishlari asosida aybga asoslanganjavobgarlik sifatida ochib berilgan
