Ekologik Xavfsizlikni Ta’Minlashda Ekopolisiya Organining Huquqiy Va Institutsional Asoslari

Abstract

Mazkur maqolada O‘zbekistonda Ekologiya va iqlim o‘zgarishi milliy qo‘mitasi tizimida shakllanayotganDavlat ekologik nazorat inspeksiyasi (Ekopolitsiya) institutining huquqiy asoslari va institutsional modeli tahlil qilingan.“O‘zbekiston – 2030” strategiyasi, PQ-184-son qaror, Ekologiya qo‘mitasi va Ekopolitsiyaga oid me’yoriy-huquqiy hujjatlarhamda ommaviy axborot manbalari asosida mazkur tuzilmaning maqomi, vakolatlari va boshqaruv tizimi ochib berilgan.Tadqiqotda normativ-huquqiy, doktrinal, institutsional va qiyosiy-huquqiy tahlil usullari qo‘llanilgan, jumladan OECD,EFFACE hamda Italiya Carabinieri “environmental police” modeli bilan qiyosiy o‘rganish amalga oshirilgan. Xulosalargako‘ra, Ekopolitsiya profilaktika, monitoring va ijroni birlashtirgan gibrid huquqni muhofaza qiluvchi organ sifatidashakllanmoqda, biroq kuch ishlatish vakolatlari, inson huquqlari, institutsional koordinatsiya va kadrlar salohiyatiga oidqator xatarlar saqlanib qolmoqda.
