Abstract

Xorijiy amaliyot tahlili shuni ko‘rsatdiki, bozor iqtisodiyoti qonunlarga asoslangan mamlakatlarda korrupsiyagaqarshi kurashish hamda jinoiy faoliyatdan olingan daromadlarni legallashtirish sohasida davlat va xususiysektor ishtirokchilarining xalqaro standartlar, qonun hujjatlari va boshqa zamonaviy usullarga muvofiq samaralifaoliyat yuritishini ta’minlovchi muhim vositalardan biri o‘z tarkibida korrupsiyaga va legalizatsiyaga qarshikurashish komplayens nazorat (compliance control) tizimini tashkil etish hisoblanadi.Komplayens nazorat tizimi ilk bor AQShda 1906-yilda vujudga keldi. Keyin farmatsevtika va oziq-ovqatsanoati sohasida tartibga soluvchi bo‘lgan birinchi FDA agentligi (Foodand Drug Administration) paydo bo‘ldi.Ammo Amerikada komplayens nazoratini rivojlantirish uchun haqiqiy turtki 1960 va 70-yillardagi yirik korrupsiyajanjallari bo‘ldi. Bu ishlarning natijasi 1977-yildagi Xorijiy korrupsiya amaliyotlari to‘g‘risidagi qonunning (FCPA‒ xorijiy korrupsiya amaliyotlari to‘g‘risida qonun) qabul qilinishi edi. Bunga zaruriyat mamlakat iqtisodiyotidaxavfsizlikni ta’minlashga qaratilgan kompaniya va korporatsiyalarning tashkil etilishi bilan bog‘liqdir.
