[Pension Funds of the Federal States and Debt Brake: “Robbing Peter to Pay Paul” or a Serious Financial Precaution?]

Abstract

Zusammenfassung Seit Mitte der 1980er Jahre ist bekannt, dass sich die zukünftigen Versorgungsverpflichtungen der Länder für ihre damals im Durchschnitt noch relativ jungen Beamten und Richter nach der Jahrtausendwende zunehmend zu Zeitbomben entwickeln würden. Als Rheinland-Pfalz 1996 als erstes Bundesland die Konsequenz aus diesem bedrohlichen Szenario zog und damit begann, einen Pensionsfonds aufzubauen, der ab etwa 2030 die vollständige Finanzierung der Pensionen, Hinterbliebenenversorgung und Beihilfeaufwendungen der seit 1996 eingestellten Beamten übernehmen sollte, wurde das Land wegen dieser innovativen und umfassenden Lösung mit viel Lob überschüttet. Seither haben sich die konkrete Praxis und die öffentliche Wahrnehmung dieses Pensionsfonds jedoch völlig verändert.
