Aile Mahkemelerinin Yapısı ve Kararları Üzerine Genel Bir Değerlendirme

Abstract

Family court is a new concept in the Turkish legal system, although it has a history in many states, particularly in USA. The main legal arrangement about family courts, which came into force on 18 January 2003, is act numbered 4787. The fundamental aim is protection of the family in the act. But the ultimate goal is to form a healthy society such as other countries. Function of the family courts is determined in the act. The basic function is to find solutions for disputes depending on family law. Features of the judges and officers of the family courts are different from the other courts. But there is not a professional proceeding. Protection of family, ending of engagement, decisions related with marriage process, divorce process, relationships, recognition and enforcement are fundamental court decisions of the family courts.
