Derechos de propiedad en la acuicultura: una aproximación desde el cultivo de mejillón en Galicia

    Este artículo hace una revisión de los procesos de cambio institucional ligados a la miticultura gallega atendiendo a la importancia reguladora de los derechos de propiedad conceptualizados como una cartera de derechos favorecedores de la ordenación de la actividad. En tres etapas diferenciadas la definición y el perfeccionamiento de los derechos de propiedad generaron la creación de estructuras de incentivos que han contribuido al desarrollo de sendas estables de crecimiento en la explotación mejillonera gallega, proporcionando una mayor eficiencia económica y una explotación sostenible. Se constatará que la actividad institucional favoreció la corrección de problemas asocia-dos a la falta de regulación en el subsector; sin embargo, también se presentarán algunas limitaciones de la ordenación institucional que afectan al desempeño miticultor, como la persistencia de externalidades negativas acumulativas no resueltas asociadas a la utilización de las rías como un re-curso de uso común. Se analizará la titularidad, dimensión y calidad de los derechos de propiedad resultantes asignados a los «bateeiros». This paper reviews the processes of institutional change linked to the Galician Mussel activity. In particular, it focused on the regulatory role of property rights, which are conceptualized as a bundle of rights that favors mussel farming management. It is argued that along three distinct stages the definition and perfection of property rights generated the creation of incentive structures that contributed to the development of stable growth paths in the Galician mussel subsector providing a greater economic efficiency and a sustainable exploitation. It is confirmed that institutional activity favored the correction of problems associated with the lack of regulation in the subsector; however, some limitations of the institutional arrangements that affect miticultor´s performance are identified, such as the persistence of cumulative unresolved negative externalities associated with the use of Galician estuaries as a common resource. The ownership, dimension and quality of the resulting property rights assigned to bateeiros are analyzed.
