Два Аргумента За Ограничение Антитраста В Реализации Прав Интеллектуальной Собственности В Развивающихся Экономиках

Abstract

Сфера обращения прав интеллектуальной собственности (ИС) и связанные с ней правоотношения являются объектом стандартной антимонопольной политики в развитых странах, за исключением отдельных уточнений. Обоснованность применения такой же антимонопольной политики в развивающихся экономиках не является бесспорной.Предмет анализа данной статьи - альтернативные опции антимонопольной политики для отношений, связанных с использованием и обращением прав ИС в развивающихся экономиках. Цель - объяснить, какие существуют препятствия для импорта институтов в развивающиеся страны при структурировании отдельно взятого набора трансакций Для этого мы выявляем обстоятельства и формулируем аргументы в пользу ограниченного применения стандартов антимонопольной политики в сфере обращения прав ИС в развивающихся странах. Эти аргументы основаны, во-первых, на задачах структурной политики, во-вторых, на предотвращении нежелательного повышения неопределенности, влияющей на выбор механизмов управления трансакциями.
