Кто Выиграл От Принятия Закона О Торговле?

Abstract

В статье оценивается регулирующее воздействие Закона о торговле (2009 г.). Для выявления участников рынка, выигравших и проигравших от принятия данного Закона, используются данные стандартизованного опроса 512 ритейлеров и поставщиков, проведенного в ноябре-декабре 2010 г. в пяти крупнейших российских городах. Для анализа масштабов и динамики административного воздействия по признакам нарушения Закона о торговле используется статистика ФАС России за 2010-011 гг. Делается вывод о том, что первые результаты действия Закона не соответствуют ранее декларированным целям. В то же время в результате расширения полномочий антимонопольного органа возросли административные издержки участников рынка, связанные с дополнительными проверками, возбуждением дел и наложением штрафов.
