Совет Рынка И Его Полномочия В Сфере Энергетики

Abstract

Основы правового статуса, а также полномочия организаций коммерческой инфраструктуры оптового рынка электроэнергии и мощности определяются в соответствии с Федеральным законом от 26.03.2003 № 35-ФЗ "Об электроэнергетике".Ключевая роль в процессе функционирования коммерческой инфраструктуры оптового рынка электроэнергии и мощности отведена Законом об электроэнергетике совету рынка. Совет рынка представляет собой особую разновидность саморегулируемой организации, наделенную наряду с частноправовыми также и публичными полномочиями в сфере электроэнергетики. Это подтверждается наличием публичной компетенции в сферах реализации квазиразрешительных процедур и контрольных полномочий, разработки формы договора о присоединении к торговой системе оптового рынка и нормативного правового регулирования, а также организации системы досудебного урегулирования споров и корпоративного санкционирования.
