Эффективность Закона И Экономика

Abstract

Роль права как важнейшего регулятора общественных отношений стала общепризнанной. В этом признании таится схоластический элемент, а именно: сам факт принятия закона и иного правового акта считается правовым воздействием, влекущим практические результаты. Увы, эта традиционная гипотеза оказалась малопродуктивной, о чем свидетельствуют многочисленные нарушения законности в экономической сфере при обилии законов. Поэтому коллектив авторов - сотрудников Института правовых исследований Государственного университета - Высшей школы экономики и других учебных учреждений (Ю.А. Тихомиров - руководитель, А.В. Кашанин, С.В. Третьяков, Е.А. Миши- на, С.В. Васильева, В.М. Баранов, М.А. Пшеничнов) провел исследование проблем эффективности законодательства в экономической сфере в рамках плана НИР. В основу была положена новая гипотеза: возможно ли определить коррелятивные связи между целями правового воздействия, его средствами и результатами в экономической среде?
