Конституционно-Правовое Регулирование Права Частной Собственности На Земельные Участки Граждан И Их Объединений

Abstract

В статье анализируются конституционно-правовые аспекты содержания права частной собственности на земельные участки. Выводится круг субъектов права частной собственности на земельные участки - граждане и их объединения. Из анализа практики Конституционного Суда России следует, что из понятия "граждане" не исключаются иностранцы и апатриды. Авторы приходят к выводу, что в контексте статьи 36 Конституции РФ под объектом права частной собственности следует понимать земельный участок, а не землю.
