Понятие Права На Осуществление Местного Самоуправления

Abstract

В статье отмечается, что хотя право граждан на осуществление местного самоуправления и не названо в числе прав и свобод человека и гражданина, содержащихся в главе 2 Конституции РФ, данное право является конституционным по смыслу части 2 статьи 3, части 2 статьи 32, статей 130-133 Конституции РФ. В научной литературе нет однозначного мнения о том, что есть "право на местное самоуправление" и "право на осуществление местного самоуправления". На основании анализа мнения таких ученых как Н.С.Бондарь, В.И. Васильев, Д.Г. Жаромских, А.Е. Еремин, В.А. Максимов, А.А. Сергеев в работе делается вывод о том, что следует различать "право на местное самоуправление" и "право на осуществление местного самоуправления". Право на осуществление местного самоуправления является совокупностью индивидуальных и коллективных прав; содержание права на осуществление местного самоуправления не связано с учреждением или упразднением местного самоуправления как такового.
