РИСК-ОРИЕНТИРОВАННЫЙ ПОДХОД В СИСТЕМЕ ГОСУДАРСТВЕННОГО КОНТРОЛЯ И НАДЗОРА В НАЛОГОВОЙ СФЕРЕ // Risk-Oriented Approach in the System of Government Control and Supervision in the Tax Sphere

The paper is concerned with problems related to the introduction of the risk-oriented approach to the activities of control and supervisory bodies to improve the control and supervision activities in the the implementation of the Administrative Reform Concept. Also considered are the problems related to the process of harmonizing the interests of the state, business and society. The introduction of the risk-oriented approach is aimed at reducing the excessive administrative burden on the business through classifying supervised facilities according to the degree of risk of damage to the values protected by law. The approach is expected to result in the reduction of audits of facilities reported to have minimum values of risk of damage indices, strengthening the preventive focus of supervisory activities, and higher incentives for businesses to comply with mandatory requirements in a bona fide and self-consistent manner. В статье рассмотрены вопросы внедрения в деятельность контрольно-надзорных органов риск-ориентированного подхода, направленного на оптимизацию контрольно-надзорной деятельности в рамках выполнения Концепции административной реформы, и проблемы, сопровождающие процесс согласования интересов государства, бизнеса и общества. Внедрение риск-ориентированного подхода имеет целью снижение чрезмерной административной нагрузки, которой подвергается бизнес, за счет распределения поднадзорных объектов по степени риска нанесения ущерба охраняемым законам ценностям. Результатами такого подхода должны стать снижение числа проверок объектов, имеющих минимальные показатели риска нанесения ущерба охраняемым законами ценностям, усиление профилактической направленности деятельности надзорных органов, а также повышение стимулов для бизнеса к добросовестному и самостоятельному соблюдению обязательных требований.
