Правовое регулирование кадастровой стоимости недвижимого имущества в России // Legal Regulation of the Cadastral Value of Real Estate in Russia

The paper explores the current state of the cadastral valuation system in the Russian Federation. The subject of research is the legislation in the sphere of the state cadastral valuation and its application practice. A review of the statistical data of the Federal Service for State Registration, Cadaster and Cartography (Rosreestr) concerning contestation of results of real estate cadastral value appraisals is made. The purpose of research was to identify the problems of legal regulation of the real estate cadastral valuation in Russia. The paper analyzes the current legislation related to the real estate cadastral valuation as well as the provisions of the new law on the state cadastral valuation. It is concluded that in the development of the state cadastral and tax policy it is of paramount importance to balance the public interests of the state in forming the budget and the private interests of citizens and businesses. The new legislation leaves the crucial issues in this area (disparity of the cadastral value and the market value of real estate, the cost of the cadastral value revision process, etc.) unresolved. Статья посвящена исследованию современного состояния системы государственной кадастровой оценки в Российской Федерации. Предмет исследования - законодательство в сфере государственной кадастровой оценки и практика его применения. В статье рассмотрен статистический материал Росреестра, касающийся оспаривания результатов определения кадастровой стоимости объектов недвижимости. Цель работы - выявление проблем правового регулирования кадастровой стоимости недвижимого имущества в России. В работе проведен анализ действующего законодательства по кадастровой оценке недвижимого имущества, а также положений нового закона о государственной кадастровой оценке. Сделан вывод о том, что при разработке государственной кадастровой и налоговой политики крайне важно соблюсти баланс публичных интересов государства по формированию бюджета и частных интересов граждан и бизнеса. Новое законодательство оставляет нерешенными важнейшие проблемы в данной области (несоответствие кадастровой стоимости и рыночной стоимости объектов недвижимости, затратность процесса пересмотра кадастровой стоимости).
