Abstract

В статье анализируется процесс реализации принципа доброй совести (bona fides) в условиях современного российского гражданского оборота. Автором разбираются сложности адаптации правоприменительной практикой положений ГК РФ, появившихся в ходе реформы гражданского права. На основе исторического и сравнительного специально-юридических методов устанавливаются некоторые ограничительные критерии принципа свободы договора.
