Abstract

В статье рассматриваются видовые и содержательные особенности фактической ошибки в оценке преступных деяний, посягающих на репродуктивные интересы. Автор проанализировал общие теоретические правила квалификации преступлений при фактической ошибке и рассмотрел их применительно к преступным посягательствам в репродуктивной сфере с учетом требований уголовного закона, а также исследования материалов судебной практики по соответствующей категории дел и результатов проведенного анкетирования. В итоге предлагаются рекомендации по нивелированию/минимизации выявленных сложностей.
