Abstract

В данной статье автор анализирует специфику установления ответственности за убийство матерью новорожденного ребенка в России и странах Балтии. Рассмотрены общие и отличительные черты законодательного и право-применительного подхода, их влияние на назначение справедливого и обосно-ванного наказания. В итоге автор предлагает новую редакцию ст. 106 УК РФ.
