Судебное Усмотрение При Заочном Производстве По Уголовным Делам

Abstract

В данной статье рассматриваются вопросы применения судебного усмотрения при заочном судебном производстве и дается определение с точки зрения науки уголовного процесса. Нормы УПК РФ, касающиеся участия подсудимого в судебном разбирательстве, реализуют принципы российского уголовного процесса, к которым относятся: охрана прав и свобод гражданина, принцип презумпции невиновности, обеспечение права на защиту, на обжалование процессуальных действий и решений. Эти принципы реализуются через судебное усмотрение при отсутствии подсудимого в судебном заседании.
