Междисциплинарный Подход К Анализу И Применению Понятия «Механизм Процессуального Доказывания»

Abstract

В данной статье предпринята попытка изучения феномена процессуального доказывания в судебном разбирательстве с позиций нескольких смежных гуманитарных наук. Имеющиеся в современной отечественной правовой теории понятия, описывающие доказывание, рассмотрены через призму когнитивных взглядов и представлений. Использован опыт представителей теории англо-саксонского права. Приведен пример альтернативной стратегии доказывания с помощью персуазивных текстов.
