Abstract

В статье рассматриваются вопросы соотношения эффективности и справедливости в правовом регулировании трудовых отношений. Выявлено различие подходов специалистов к пониманию этих явлений, возможные пути поиска баланса интересов работников и работодателей. Проанализировано воздействие правовых норм на поведение участников трудовых отношений как экономических субъектов. Исследованы экономические основания для правовой регламентации дистанционного труда, заемного труда, введения эффективного контракта в сфере высшего образования. Сформулированы некоторые предложения по совершенствованию трудового законодательства.
