Расширение Частных Начал В Судебно-Экспертной Деятельности

Abstract

Статья посвящена одному из проявлений частных начал в уголовном процессе возможности назначения и проведения экспертиз вне государственных экспертных учреждений. Определены критерии выбора сторон, следователя, суда относительно назначения производства судебной экспертизы в негосударственном судебно-экспертном учреждении. Проанализированы законодательный и научный подходы к определению понятий «негосударственные экспертные учреждения» и «иные эксперты». Выявлены имеющиеся в процессуальном законодательстве и законодательстве о судебной экспертной деятельности противоречия относительно процессуального статуса, полномочий и компетенции государственных и негосударственных судебных экспертов. Предложено реформирование судебно-экспертной деятельности, предусматривающее принятие закона, регламентирующего деятельность государственных и негосударственных экспертных учреждений и частных экспертов; создание на государственном уровне квалификационных, аттестационных и лицензионных структур.
