Антимонопольное Законодательство Как Необходимое Условие Формирования Конкурентной Среды

Abstract

Историческими предпосылками для формирования антимонопольной политики США в конце XIX века послужило перерастание местных рынков в национальные по мере совершенствования транспортных средств и развития транспортной системы, постоянно возрастающий уровень механизации производства, а так же получавшая все более и более широкое распространение акционерная форма делового предприятия. Все это оказало мощное воздействие на развитие трестов и картелей, то есть предпринимательских монополий и привело к «вымыванию» малого и среднего бизнеса. С целью оздоровления сложившейся ситуации на рынке в 1890 г. был принят антитрестовский «Закон Шермана». С тех пор он остается базовым антимонопольным законом, на котором основывается антимонопольная политика США [7].
