О Некоторых Актуальных Проблемах Исполнительного Производства И Возбуждения Производства По Делу О Банкротстве Организации

Abstract

Статьей 60 Федерального закона от 21 июля 1997 г. № 119-ФЗ «Об исполнительном производстве» [5, ст. 3591] (в редакции Федерального закона от 29 июня 2004 г. № 58-ФЗ [7, ст. 2711]) предусмотрены весьма важные нормы, имеющие целью защиту законных интересов остальных кредиторов должника-организации, и прежде всего бюджета и государственных внебюджетных фондов, при обращении взыскания на основные производственные фонды такого должника-органи-зации (об их составе см. п.3 ст.59 Федерального закона «Об исполнительном производстве», далее именуемого «Закон») по исполнительному документу в пользу кредитора-взыскателя, оказавшегося, условно говоря, «самым шустрым» из кредиторов данного должника-организации.
