Abstract

Статья посвящена проблеме «скрытых трудовых отношений», выражающейся в необоснованном заключении гражданско-правовых договоров вместо трудовых договоров, что влечет нарушение трудовых прав работников и прав в области социального обеспечения. Авторами проанализированы характерные черты трудовых отношений, позволяющие отграничить их от иных отношений, связанных с реализацией человеком способности к труду.
