Модели Организации Контрактной Службы В Свете Реформы Государственных И Муниципальных Закупок

Abstract

Вступление в силу федерального закона от 5 апреля 2013 г. № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд» (далее ФЗ № 44) вызвала дискуссии о проблемах формирования тех структур, которые должны реализовывать новые нормы о контрактных отношениях. В статье анализируется опыт европейских стран и США по вопросу организации кадрового обеспечения закупочных процессов; указаны основные проблемы, с которыми сталкиваются государственные и муниципальные заказчики при создании контрактных служб и назначении контрактных управляющих. Автор предлагает выделять три модели организации кадрового обеспечения контрактных отношений, определяет наиболее оптимальные способы решения вопросов организации контрактных служб.
