Abstract

В статье анализируется процессуальное законодательство России и Украины, регулирующее участие в гражданском судопроизводстве органов государственной власти, рассматривается ряд вопросов, связанных со спецификой их привлечения и участия в процессе. С учетом конституционного принципа разделения властей на законодательную, исполнительную и судебную, предлагается обозначать органы, которым предоставлено право участия в гражданском судопроизводстве от своего имени в защиту интересов других лиц, как «органы законодательной власти» и «органы исполнительной власти», исключая при этом, соответственно, органы судебной власти.
