Abstract

Разумность является важной категорией в системе частноправового регулирования и представляет собой отраслевой принцип гражданского права (характеризует наиболее существенные черты гражданского права). Несмотря на всю важность этой категории, ее легального определения в гражданском законодательстве до сих пор нет. В определенном смысле между разумом и правом можно поставить знак равенства. Право представляет собой феномен разума, выражающий объективные ценности и требования человеческого бытия и являющийся безусловным источником и абсолютным критерием всех человеческих установлений, включая позитивное (писаное) право.
