Abstract

В статье анализируется природа налогового администрирования трансфертного ценообразования. «закон сохранения налога в группе компаний», создавая основу для такого администрирования, одновременно требует наличия института симметричной корректировки. Введенные с 1 января 2012 года правила симметричной корректировки позволяют избежать двойного обложения экономических результатов одной и той же сделки, что особенно актуально в отношении сделок в россии. однако ряд существенных недостатков не позволяет говорить о надежном механизме реализации симметричных корректировок и, соответственно, об адекватном налогообложении группы компаний.
