Abstract

В статье рассматриваются проблемы конкуренции общих и специальных норм гражданского права при заключении субдоговоров. Особое внимание автором уделено анализу презумпции отсутствия согласия кредитора основного договора на заключение субдоговора.The article considers the problems of competition of general and special norms of civil law at the conclusion of outsourcing watch. Special attention of the author is given to the analysis of the presumption of absence of the consent of the creditor of the principal contract for the conclusion of subcontracts.
