Abstract

Представленная статья посвящена анализу правого регулирования защиты прав инвесторов в процессе эмиссии ценных бумаг. В статье рассматриваются конкретные правовые формы и способы защиты прав инвестора при недобросовестной эмиссии. В частности, анализируются правовые последствия и способы защиты имущественных прав инвестора в случае признания выпуска эмиссионных ценных бумаг несостоявшимся или недействительным. Раскрывается порядок возврата инвесторам средств инвестирования, полученных эмитентом в счет оплаты ценных бумаг, выпуск которых признан несостоявшимся или недействительным, а также ряд иных вопросов.
