Abstract

В статье рассматривается процессуальное положение суда как участника уголовного процесса, для чего сравниваются различные точки зрения известных учёных-процессуалистов о роли суда в системе доказывания по уголовным делам. Проводится анализ правового положения и роли суда в современном уголовном процессе Российской Федерации и их изменения в условиях развития состязательных начал отечественного правосудия.
