Понятие И Общая Характеристика Недобросовестной Конкуренции

Abstract

Недобросовестная конкуренция традиционно рассматривается как постоянный спутник свободной конкуренции, которая, в свою очередь, выступает в качестве одного из клю- чевых условий, обеспечивающих гармонию спроса и предложения на рынке товаров и услуг. Наличие свободной конкуренции на рынке, характерное для развитых систем эко- номических отношений, предполагает равенство условий хозяйствования для участников этих отношений, которое без надлежащего государственного воздействия не может быть достигнуто. Одной из форм такого воздействия выступает специально конструируемый институт недобросовестной конкуренции, призванный защитить участников гражданского оборота1, в том числе потребителей товаров, работ и услуг, от действий хозяйствующих субъектов, направленных на получение последними определенных преимуществ. В статье автор ставит цель - проанализировать и критически оценить модель недобросовестной конкуренции, принятую российским законодателем, на современном этапе развития гражданского оборота.
