Пряма Я Дискредитация Конкурента Как Вид Недобросовестной Конкуренции

Abstract

В статье представлена развернутая характеристика и рассмотрены признаки прямой дискредитации конкурента, являющейся одним из типов актов недобросовестной конку- ренции, запрещенной Федеральным законом «О защите конкуренции»1. На основе юридического анализа правовых норм федерального законодательства РФ, судебных решений и специализированной научной литературы автор раскрывает спе- цифику распространения ложных, неточных или искаженных сведений, которые могут причинить убытки хозяйствующему субъекту либо нанести ущерб его деловой репутации. Автор обобщает опыт юридической регламентации конкурентных отношений и предлагает свои решения отдельных проблем квалификации действий хозяйствующих субъектов как актов прямой дискредитации конкурента.
