Abstract

Федеральным законом от 29 июля 2009 г. № 216-ФЗ в ст. 178 Уголовного кодекса РФ «Недопущение, ограничение или устранение конкуренции» 1 внесен ряд поправок, отражающих существенные перемены в отношении государства к роли уголовного закона как инструмента защиты интересов честной конкуренции в нашей стране. Поправки, внесенные в «антимонопольную» статью уголовного закона, вступили в силу 30 октября 2009 г. Принятию закона предшествовал длительный - можно сказать, изнурительный - процесс разработки законопроекта, стартовавший в апреле 2006 г. Первоначальный вариант, подготовленный специалистами Института государства и права РАН, затем дорабатывался и согласовывался с участием представителей всех заинтересованных сторон: администрации президента РФ, Минюста РФ, Минэкономразвития РФ, МВД РФ, ФАС. Несмотря на то что принятый законодателем вариант новой редакции ст. 178 УК РФ заметно отличается от конкурсной разработки ИГП РАН, ключевые новеллы остались практически нетронутыми.
