Антимонопольные Дела Против Российских Нефтяных Компаний (2008-2009 Гг. ): Новые Цели И Новые Инструменты Государственной Политики?

Abstract

Одной из центральных проблем применения нормы о злоупотреблении коллективным доминированием в виде высоких цен является проблема доказательства того, что ус- тановленный уровень цены объясняется именно монопольным поведением компаний. В российских делах против нефтяных компаний, которые были возбуждены осенью 2008 г., подобного рода доказательства не были предоставлены, антимонопольный ор- ган и суды опирались в основном на данные о соотношении динамики мировых цен на нефть и динамики розничных цен на нефтепродукты. Цель данной статьи - проанализировать эффективность и обоснованность применения антимонопольного законодательства для противодействия высоким ценам на российских рынках нефтепродуктов.
