Анализ Опыта Антимонопольной Политики В Сфере Борьбы Со Сговором В Странах Переходной Экономики: Страны Цве

Abstract

В данной статье проведен анализ антимонопольного опыта в сфере противодействия соглашениям, ограничивающим конкуренцию, в странах ЦВЕ (Болгария, Венгрия, Латвия, Литва, Польша, Румыния, Словакия, Словения, Чехия, Эстония), включая реформы законодательства и особенности и проблемы правоприменения. Перечислены основные характеристики антимонопольной политики в сфере сговора, а также показано, как интеграционные процессы в рамках ЕС предопределили развитие национальной антимонопольной политики, в том числе смещение в сторону подхода «rule of reason». С другой стороны, описаны институциональные особенности данных стран в логике проведения антимонопольных реформ и в дизайне инфорсмента. В статье проанализированы проблемы, все еще актуальные для стран переходной экономики в сфере борьбы с картелями, включая проблему оптимального уровня жесткости запретов, и проблемы взаимодействия административного и уголовного права и поиска оптимального дизайна ПОН.
