Аукцион - Достаточное Условие Конкуренции? Сговор На Рынке Государственных Закупок

Abstract

В антимонопольном законодательстве большинства стран нелегальными по букве закона (per se) признаются горизонтальные соглашения между участниками рынка не только в случае фиксирования цены, раздела рынка, но и в случае соглашения о ценовых заявках на торгах (bid-rigging). В данной статье представлен обзор и дана академическая оценка поведению участников рынка на торгах, которое способствует формированию и поддержанию сговора, но с некоторыми особенностями, характерными для аукционов. Приведенные примеры дел о сговоре на торгах на фармацевтическом рынке, раскрытые российским антимонопольным органом, демонстрируют примеры применения компаниями ценовых стратегий, нацеленных на поддержание цены, позволяющей получать монопольную прибыль.
