Abstract

Необходимость принятия так называемого второго антимонопольного пакета - комплекса мер и поправок в законодательство - продиктована современной российской действительностью, которую отличают злоупотребление рыночной властью со стороны государственных органов управления, грубейшие антиконкурентные действия со стороны участников рынка. За это нарушители должны нести уголовную ответственность. Одна из основных инициатив второго антимонопольного пакета - новая редакция ст. 178 Уголовного кодекса РФ, предусматривающая уголовную ответственность за наиболее тяжкие нарушения антимонопольного законодательства. Поправки, составляющие второй антимонопольный пакет, призваны сделать правовой инструментарий борьбы с антиконкурентной деятельностью более современным, адекватным существующей экономической действительности и способствовать поддержанию благоприятной конкурентной среды в стране. По просьбе редакции журнала о новациях в антимонопольном регулировании рассказал начальник Аналитического управления Федеральной антимонопольной службы Алексей Геннадьевич Сушкевич.
