Норма О Коллективном Доминировании В Российской Антимонопольной Практике

Abstract

В статье анализируется практика применения нормы о коллективном доминировании в России в 2006 2011 гг. Основой для анализа послужили решения антимонопольной службы России, в которых была применена норма о коллективном доминировании. Автором исследуется, насколько полно использовались предусмотренные законом характеристики структуры рынка для квалификации компаний в качестве коллективно доминирующего, анализируется, какие типы обвинений предъявлялись компаниям на основе установления коллективного доминирующего положения, дается оценка судебной практике применения рассматриваемой нормы.
