Abstract

Objective: to develop conceptual theoretical and legal provisions and scientific recommendations on the identification, analysis and elimination of risk. Methods: universal dialectic method of cognition, as well as scientific and private research methods based on it. Results: the system was researched of risks diagnostics in the legal sphere and mechanism of influencing the "risk situations" and their consequences (damage to the environment and harm to society). The concept of risk in the legal sphere was formulated; the author's classification of risks in the legal sphere is presented. The rules of analysis, evaluation and prevention of risks and the model risk management framework are elaborated. Scientific novelty: the mechanism for the identification, analysis and elimination of risk has been developed and introduced into scientific circulation; the author has proposed the classification and types of risks, the reasons and the conditions promoting the risk occurrence. Practical significance: the provisions and conclusions of the article can be used in the scientific, law-making and law-enforcement activity, as well as in the educational process of higher educational establishments.
