Антикоррупционная Экспертиза Правоприменительных Актов

Abstract

Цель: обосновать общественную потребность, определить предмет, методологические и организационные возмож- ности антикоррупционной экспертизы правоприменительных актов. Методы: всеобщий диалектико-материалистический метод, используемый для познания потребности антикорруп- ционной экспертизы правоприменительных актов в механизме правового регулирования; основанные на нем обще- научные и специальные (формально-юридический и сравнительно-правовой) методы исследования в определении предмета предлагаемой экспертизы. Результаты: показано значение антикоррупционной экспертизы правоприменительных актов, определены кор- рупциогенные факторы и коррупционные показатели правоприменительных актов, предложены пути организации проведения таких экспертиз. Научная новизна: обоснованы потребность и предмет, предложены методы нового вида антикоррупционной экс- пертизы. Практическая значимость: определены условия коррупционного поведения, создаваемые в правоприменительной деятельности, и предложены методы их выявления.
