Медиация, Восстановительное Правосудие И Социальная Реинтеграция Правонарушителей: Последствия Мер, Альтернативных Уголовному Наказанию

Abstract

Цель: определить место и значение медиации в системе мер противодействия преступности в современной Германии. Методы исследования: диалектический метод познания, сравнительного правоведения, историко-правовой. Результаты: на основе анализа законодательства Германии и других государств, регулирующих вопросы восста- новительного правосудия, литературных источников, автор раскрыл содержание медиации и ее место в восстано- вительном правосудии Германии, перспективе использования этого инструмента противодействия преступности. Научная новизна: обусловлена тем, что впервые в российской научной литературе дается анализ института меди- ации и практики его применения в Германии.Практическая значимость исследования: основные положения и выводы статьи могут быть использованы в науч- ной и образовательной деятельности при осуществлении сравнительно-правовых исследований института медиации.
