Действия И Решения Суда При Подготовке Дела И Жалобы К Проверке В Апелляционной Инстанции

Abstract

На основе анализа действующего законодательства и примеров из практики автор обращает внимание на то, что формулировка закона, согласно которой исследуемая мера пресечения избирается в отношении осужденных «…до вступления приговора в законную силу», приводит к неопределенности в правовом положении осужденных. Более того, не указание в приговоре конкретной даты, до которой установлена данная мера, лишает осужденных возможности поставить на обсуждение суда вопросы законности и обоснованности весьма длительного и практически неконтролируемого содержания под стражей. Автор настаивает на возвращении к порядку обязательного обсуждения этого вопроса при подготовке дела к апелляционной проверке, в судебном заседании, с обеспечением прав заинтересованных лиц.
