Способы Установления Состояния Невменяемости В Административном Судопроизводстве По Материалам Судебной Практики

Abstract

Автор осуществил анализ практики применения положений ст. 2.8 «Невменяемость» Кодекса РФ об административных правонарушениях судами Российской Федерации. На основе проведенного анализа им выявлено, что судами используются различные способы установления состояния невменяемости лица – нарушителя норм законодательства об административных правонарушениях. Это обусловлено тем, что судами в основу установления состояния невменяемости при разрешении конкретных дел кладутся разнообразные фактические данные. Указанные фактические данные автор статьи объединил в 4 группы.Дана оценка каждому способу установления состояния невменяемости лица, что позволило сделать вывод о необходимости упорядочивания действий лиц, рассматривающих дела об административных правонарушениях, по определению состояния невменяемости правонарушителя и предложить один из возможных вариантов разрешения выявленной проблемы.
