Abstract

В статье дана оценка редакции ст. 173.1 УК РФ и современного состояния правоприменительной практики по уголовным делам о незаконном образовании (создании, реорганизации) юридического лица; на основе эмпирического материала рассмотрены проблемы, возникающие при квалификации указанных преступлений. Авторы констатируют, что неудовлетворительные результаты борьбы с «фирмами-однодневками» обусловлены несовершенством действующего уголовного законодательства, и приходят к выводу о необходимости декриминализации указанных преступлений с одновременным установлением административной ответственности за такие деяния, а также исключения ст. 173.1 УК РФ либо изменения ее редакции.
