Abstract

На основе постклассической методологии доказывается, что правовая реальность России состоит из трех уровней: правотворчество, правореализация, правовое поведение. Определяющим уровнем правовой реальности является правовое поведение, которое ориентировано на соблюдение неписанного права. Правовая реальность России характеризуется трансгрессивным состоянием современного российского общества, выражающимся в широком распространении незаконодательных (неправовых) практик, низком уровне нормативной правовой культуры, правовом нигилизме и правовом инфантилизме.
